Notice of Privacy for Suppliers, Prospects and Customers
MIDIKA INTERNATIONAL S.A. de C.V. (“MIDIKA”), located in Carretera Federal Tramo Salamanca-Irapuato km.320, S/N, Int.B, San Vicente de Flores, Salamanca, Gto, CP 36785, in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Individuals (the “Law”) and its Regulations, is responsible for the use and protection of your personal data which will be treated based on the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility in terms of the Law, and in this regard we inform you of the following:
a) Purposes.
The personal data that we collect from you through electronic, physical or telephone means, verbally and / or by writing, we will use them for the following purposes:
- Collect general data to identify you as a visitor to MIDIKA’s facilities, the above for security reasons.
- Prove your identity and / or your legal representative and / or endorsement.
- Prepare your dossier.
- Register your data in our information systems.
- Prepare purchase orders and/or contracts for the purchase and sale of goods and/or services
- Know location for product shipment.
- Provide the goods and / or services requested.
- Prepare promissory notes.
- Prepare invoices and/or track your payments.
- Generate credit notes.
- Know your credit history.
- Request commercial references.
- Perform collection work.
- Perform customer service
- Sending notices regarding changes to this Privacy Notice.
In addition, we will use your personal information for the following secondary purposes that are not necessary for a legal and / or contractual relationship but that allow us and facilitate us to provide you with better service as a prospect and / or client:
- Evaluate the quality of the goods and/or services provided.
- Notify about new goods and / or services that are related to those already contracted, and / or acquired, and / or communicate about changes in them.
- Address your doubts, complaints, suggestions and / or follow up on them.
If you do not wish that your personal data be processed for this additional purpose, from this moment you can communicate the above, or where appropriate you have a period of 5 (five) business days to express your refusal to process or use your personal data for the secondary purpose mentioned above through the mechanism indicated in subparagraphs e) and f) of this Privacy Notice.
It is important to point out that MIDIKA is not responsible for the veracity or accuracy of the personal data and / or sensitive data that you provide us, given the fact that they have not been previously validated and / or verified.
b) Personal data that we will use.
The list of personal data that we may process and/or transmit consists of:
- Name(s) and surname(s).
- Age.
- Image recorded from MIDIKA´s surveillance cameras.
- Enterprise.
- Address.
- Federal Taxpayers Register.
- Email for notifications.
- Phone numbers.
In addition to the personal data mentioned above, for the purposes reported in this Privacy Notice we will use the following personal data considered as patrimonial and financial, which are equated to sensitive data in terms of the Law, which require special protection:
- Bank account number and details.
- Tax information.
MIDIKA will implement the security, technical, administrative and physical measures necessary to ensure the integrity of your personal data and prevent its damage, loss, alteration, destruction or unauthorized use, access or treatment. Only authorized personnel, who have complied with and observed the corresponding confidentiality requirements, may participate in the processing of your personal data. Authorized personnel are prohibited from allowing access by unauthorized persons and using their personal data for purposes other than those established in this Privacy Notice. The obligation of confidentiality of the persons involved in the processing of their personal data persists even after the relationship with MIDIKA has been terminated.
c) Knowledge of your personal data.
We inform you that your personal data are shared inside and outside the country with customers or suppliers of MIDIKA themselves who must as a minimum observe the provisions contained in this Notice of Privacy. Therefore, we inform you that MIDIKA will not use your data for purposes other than those mentioned in this Notice.
d) Transfer of personal data.
MIDIKA may transfer your personal data to the persons listed in paragraph c) above, solely for the purpose of fulfilling the purposes described in this Notice of Privacy. MIDIKA may also transfer your personal data in the cases specifically provided for in the Law.
Likewise, we inform you that for any transfer of information to third parties, other than those set forth in the immediately preceding paragraph, in terms of the Law we require to obtain your consent. e) Access, Rectification or Cancellation of your personal data; or Opposition to its use.
You have the right to know what personal data we hold about you, what use we make of it, and the conditions of use we give it (Access). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate, or incomplete (Rectification); that we delete it from our records or databases when it considers that it is not being used in accordance with the principles, duties and obligations provided for in the regulations (Cancellation); as well as to oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.
To exercise any of the ARCO rights, you must notify and request in writing the Access, Rectification, Cancellation or Opposition of your personal data. Such application shall contain:
- The name of the owner and address or other means to communicate the response to your request.
- The documents that prove the identity or, where appropriate, the legal representation of the owner.
- The clear and precise description of the personal data with respect to which it is sought to exercise any of the aforementioned rights.
- Any other element or document that facilitates the location of personal data.
In case of requesting the rectification of your Personal Data, you must additionally indicate the modifications to be made and provide the necessary official documentation that supports your request.
MIDIKA will respond to the email address, which the owner of the Personal Data designates in his request, having the option to indicate a different means of receiving the response. MIDIKA will respond within a maximum period of 20 (twenty) calendar days or the maximum allowed by law. MIDIKAS’s response will indicate whether the request for access, rectification, cancellation or opposition is proceeds and, where appropriate, MIDIKA will make the determination effective within 15 (fifteen) calendar days following the date on which it communicates the response or the maximum allowed by law. The deadlines may be extended in the terms indicated by the applicable law.

f) Revocation of consent for the use of your personal data.
You can revoke the consent that, when appropriate, you have given us for the processing of your personal data. However, it is important that you bear in mind that not in all cases we will be able to meet your request, or terminate the use of your personal data immediately, since it is possible that due to some legal obligation, we require to continue processing your personal data. You should also consider that, for certain purposes, the revocation of your consent will imply the termination of your relationship with us.

g) Limitation of use or disclosure of your personal data.
In order for you to limit the use or disclosure of your personal information, we offer you the following means:
- Your registration in the Public Registry to Avoid Advertising, which is in charge of the Federal Consumer Prosecutor’s Office (PROFECO), so that your personal data is not used to receive advertising or promotions from companies of goods or services. - Your registration in the list of exclusion of prospects and / or customers, so that your personal data is not used for marketing, advertising or commercial prospecting purposes by us.
